Welcome to DineHire餐才匯, officially known as 餐才匯人力社. These Terms and Conditions ("Terms") govern your access to and use of our website and services, which connect employers in the hospitality and Food & Beverage sectors with job seekers. By accessing or using our services, you agree to comply with these Terms. If you do not agree with any part of these Terms, please refrain from using our services.
1. Acceptance of Terms
By utilizing the DineHire餐才匯 platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. We reserve the right to modify these Terms at any time without prior notice. Continued use of our services after changes have been made constitutes acceptance of those modifications.
We will notify users of material changes to these Terms through email or a prominent notice on our website. It is your responsibility to review such notifications and stay informed of updates.
2. Definitions

"Employers": Businesses in the hospitality and Food & Beverage sectors (e.g., restaurants, cafes, bars, hotels) that post job listings on our platform.

"Job Seekers": Individuals seeking employment in the hospitality and Food & Beverage industries for roles such as waiters, baristas, bartenders, managers, chefs etc.

"Users": Employers and Job Seekers, accessing or using the platform.

"Services": All functionalities provided by DineHire餐才匯 through our website.

The formal employment contract will be directly established between the employer and the job seeker,
DineHire餐才匯 will only act as a platform facilitator.
3. User Responsibilities

Users must provide accurate and current information when creating profiles or posting job listings. You are responsible for maintaining the accuracy of this information.

Employers must ensure that their job postings comply with all applicable laws and regulations in Taiwan and must not post any fraudulent or misleading job offers.
Job Seekers are encouraged to conduct their own research and due diligence before accepting any job offers.
DineHire餐才匯 does not endorse any Employers or job listings.
Job Seekers must ensure that they are legally authorized to work in Taiwan. DineHire餐才匯 is not responsible for verifying this requirement, which is the sole responsibility of the Employers during the hiring process.
Job Postings:
DineHire餐才匯 provides a platform for Employers to create job postings that are accessible to other users. By creating a job posting, you agree not to include or allow any content that:

Contains URLs or links directing users to third-party websites.

Infringes upon, misappropriates, or violates any third party’s intellectual property rights, including copyrights, trademarks, trade secrets, or rights of privacy/publicity.

Utilizes keywords, meta tags, or hidden text that infringe on third-party trademark rights or are irrelevant to the job posting.

Is discriminatory or promotes discrimination, bigotry, racism, hatred, harassment, or harm toward any individual or group.

Contains violent, threatening, or harmful language or promotes actions that are threatening to others.

Is unlawful, defamatory, obscene, vulgar, libelous, or otherwise objectionable on racial, ethnic, or other grounds.

Disparages, embarrasses, or offends any person or entity.

Includes false, inaccurate, fraudulent, or misleading information, opinions, or notices, whether commercial or otherwise.
Each job posting must be specific to a single job opening. Posting multiple roles or positions within one job posting is not permitted. Job postings should provide clear and sufficient details to accurately describe the nature and requirements of the opportunity, ensuring clarity for potential applicants.
DineHire餐才匯 is not obligated to pre-screen job postings. However, at its sole discretion, DineHire餐才匯 reserves the right to pre-screen, edit, refuse, or remove any job posting that:

Violates the terms outlined in this section,

Is deemed not in the best interests of users,

Negatively impacts the overall user experience on the platform.
4. Account Security
Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their accounts. If you suspect any unauthorized use of your account, you must notify us immediately. We are not liable for any loss or damage arising from your failure to comply with this security obligation.
We strongly encourage users to create strong passwords and enable multi-factor authentication to enhance account security.
5. Intellectual Property Rights
All content on the DineHire餐才匯 website—including text, graphics, logos, software, and other materials—is owned by DineHire餐才匯 or its licensors. Unauthorized use of any materials is strictly prohibited. You may not reproduce, distribute, modify, or create derivative works from any content without prior written consent from us.

We do not guarantee the accuracy or completeness of any job listings or user profiles. You acknowledge that we are not responsible for the actions or omissions of any users of our platform. DineHire餐才匯 does not guarantee the legality, quality, or accuracy of job listings. Job seekers must verify the legitimacy of employers independently.
Users waive any claims against DineHire餐才匯 for losses incurred due to service interruptions, errors, or delays in the delivery of services.
7. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy.
8. Termination of Services
We reserve the right to suspend or terminate your access to our services at any time without notice if you violate these Terms or engage in conduct deemed inappropriate by us. Upon termination, your right to use our services will cease immediately.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Taiwan, excluding any principles of conflicts of law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Taiwan. Any legal proceedings related to these Terms shall be conducted in the courts located in Taipei, Taiwan. We will make reasonable efforts to resolve disputes promptly and in good faith.
10. Indemnification
You agree to indemnify and hold harmless DineHire餐才匯, its affiliates, officers, directors, employees, agents, and licensors from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising directly or indirectly from your actions or omissions on the platform, including but not limited to your use of our services, breaches of these Terms, violations of applicable laws, or claims related to third-party intellectual property infringement.
11. Changes to Terms
We may update these Terms periodically to reflect changes in our practices or for other operational reasons. We will notify users of significant changes through email or a notice on our website. Your continued use of the services after such changes constitutes acceptance of the new Terms.
12. Disclaimer of Warranties
Our services are provided on an "as-is" and "as-available" basis without warranties of any kind either express or implied. We do not warrant that our services will be uninterrupted or error-free or that defects will be corrected.

You acknowledge and agree that DineHire餐才匯 shall not be responsible for any damages arising from your use of such sites.
14. User Conduct
Users agree to engage in respectful communication and conduct while using our services. Harassment, discrimination, or any form of abusive behavior towards other users will not be tolerated and may result in account suspension or termination.
15. Dispute Resolution
In the event of any dispute arising from these Terms or your use of our services, you agree to first attempt to resolve the dispute informally by contacting us at info@dinehire.com. If resolution cannot be reached through informal means, you agree to submit the dispute to mediation before pursuing legal action.
16. Force Majeure
DineHire餐才匯 shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond DineHire餐才匯's reasonable control, including but not limited to mechanical failures, electronic disruptions, natural disasters, pandemics, acts of government authorities, war, terrorism, riots, labor disputes, or other events beyond reasonable control.
Users will be notified of any interruptions caused by force majeure events as soon as feasible.
In the event of prolonged interruptions due to force majeure, users may choose to terminate their accounts or suspend their use of the services without penalty.
17. User-Generated Content
Any content you post on our platform remains your property; however, by posting content (including resumes and job listings), you grant DineHire餐才匯 a non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute such content for promotional purposes related to our services.
This license is only for purposes related to the platform’s operations or promotional activities.
DineHire餐才匯 will not alter or misuse user-generated content in a manner inconsistent with its original purpose or without the user’s consent.
18. Age Restrictions
You must be at least 18 years old to use our services. By using our platform, you represent that you meet this age requirement and are legally authorized to work in Taiwan. We may request proof of age or work authorization to verify compliance with this requirement. Failure to provide adequate proof upon request may result in account suspension or termination.
19. Feedback
We welcome feedback regarding our services; however, we reserve the right to remove any feedback deemed inappropriate or offensive at our discretion.
20. Severability

用戶:包括雇主與求職者,使用平台的所有個人或機構。

服務:透過DineHire餐才匯於網站提供的所有功能與服務。

正式的雇佣合約將由雇主與求職者直接訂立,DineHire餐才匯僅充當平台的促進者。
3. 用戶責任

用戶在建立個人資料或發佈職缺時,必須提供準確及最新的資訊,並且負責維護這些資訊的正確性。

雇主須確保其職缺信息遵守台灣所有適用的法律及規範,並且不得發佈任何欺詐或誤導性的招聘信息。
我們鼓勵求職者確保在接受任何工作邀約前進行充分的調查。
DineHire餐才匯不對任何雇主或職缺信息進行背書。求職者須確保他們具有在台灣工作的合法資格,DineHire餐才匯不負責核實此要求,該責任由雇主在招聘過程中承擔。
職缺招聘:
DineHire餐才匯提供平台,讓雇主建立可供其它用戶查看的職缺招聘。透過建立職缺招聘,您同意不包含或允許任何以下內容:

包含指向第三方網站的網址或連結。

侵犯、盜用或違反任何第三方的智慧財產權,包括版權、商標、商業機密或隱私/公開權。

使用侵犯第三方商標權的關鍵字、元標籤或隱藏文本,或與職缺招聘無關的內容。

具有歧視性或促使歧視、偏見、種族主義、仇恨、騷擾或對任何個人或群體造成傷害的言論。

包含暴力、威脅或有害語言,或促使對他人有威脅的行為。
-
非法、誹謗、猥褻、粗俗、誣蔑或在種族、族群或其他方面令人反感的內容。
-
詆毀、使人難堪或冒犯任何人及群體的內容。
-
包含造假、不準確、詐騙或誤導性的資訊、意見或公告,無論其為商業性或其他性質。
每個職缺招聘必須針對單一職位,不得在同一職缺招聘中發佈多個職位或工作角色。職缺招聘應提供清晰且充分的細節,準確描述工作機會的性質和要求,以確保潛在求職者能夠理解職缺內容。
DineHire餐才匯並不負責預先審核職缺招聘。然而招聘職缺若包含以下內容,DineHire餐才匯保留自行決定預先審核、編輯、拒絕或移除任何職缺招聘的權利,詳見如下:

對平台的整體用戶體驗造成負面影響。
4. 帳號安全
用戶有責任保持其帳戶信息的機密性,並對其帳戶下的所有行動負責。如懷疑帳戶遭到未經授權的使用,必須立即通知我們。對於您未遵守此安全義務所造成的任何損失或損害,我們將不予承擔責任。
我們強烈建議用戶建立高強度密碼並啟用多重身份驗證,以加強帳戶安全。
5. 智慧財產權
DineHire餐才匯網站上的所有內容,包括文字、圖形、標誌、軟體及其他資料,均為DineHire餐才匯或其授權方所擁有。未經授權,均嚴格禁止使用任何資料。您不得在未經我們書面同意的情況下,複製、分發、修改或創建任何內容的衍生作品。
用戶可下載或保存資料供個人及非商業用途,前提是該行為符合這些條款。未經授權的使用包括但不限於在未獲得DineHire餐才匯明確書面許可的情況下,為商業目的複製、分發或修改內容。

DineHire餐才匯對於您使用我們的服務或雇主與求職者之間的任何互動所產生的直接、間接、附帶、後果性或懲罰性損害不承擔任何責任。我們不保證任何職缺信息或用戶資料的準確性或完整性。您接受我們不對平台任何用戶的行為或疏忽負責。DineHire餐才匯不保證任何職缺的合法性、品質或準確性。求職者必須獨立驗證雇主的合法性。
用戶免除對DineHire餐才匯因服務中斷、錯誤或延遲交付服務而產生的損失提出任何索賠的權利。
7. 隱私政策
您的隱私對我們非常重要。請查閱我們的隱私政策,了解我們如何收集、使用及保護您的個人資料。使用我們的服務即表示您同意根據我們的隱私政策收集並使用您的資料。
8. 服務終止

DineHire餐才匯對因超出其合理控制範圍的原因(包括但不限於機械故障、電子中斷、自然災害、疫情、政府機構行為、戰爭、恐怖主義、暴亂、勞資糾紛或其他超出合理控制的事件)而未能履行本條款下的義務不承擔責任。
如遇不可抗力事件,我們將在可行的情況下通知用戶。
如因不可抗力事件導致的長期中斷情況下,用戶可選擇終止帳戶或暫停使用服務,且不需承擔任何罰金。
17. 用戶生成內容
您在我們平台上發佈的任何內容仍為您個人的財產;然而,通過發佈內容(包括履歷及職缺信息),您授予DineHire餐才匯一項非獨佔、免版稅的許可,允許其使用、複製、修改、發佈和分發該內容,以促進與我們服務相關的宣傳目的。該許可僅限於與平台運營或宣傳活動相關等目的。
DineHire餐才匯不會以與原始目的不一致的方式或在未經用戶同意的情況下更改或濫用用戶生成的內容。
18. 年齡限制
